These Terms of Service ("Terms") govern your use of landfallfreight's website and freight forwarding services. By requesting a quote or engaging our services, you agree to these Terms.
1. Nature of Services
landfallfreight coordinates freight forwarding and related logistics services through ocean carriers, air carriers, trucking companies, warehouses, and appropriately licensed customs brokerage partners. We do not claim to own or operate vessels, aircraft, or trucks, or to perform licensed customs business ourselves; our role is to coordinate your shipment through qualified third-party providers.
2. Quotations
Quotes are based on the information you supply and the rates and service conditions available at the time of quotation. Each written quote states its validity period and agreed scope. Charges may change when shipment details, measured weight or dimensions, classification, destination conditions, customs requirements, carrier rates, fuel surcharges, or other shipment-dependent facts differ from the information quoted.
3. Limitation of Liability
Our liability for loss, damage, or delay is limited to the terms set out in the applicable bill of lading, air waybill, or carrier tariff, and standard industry liability conventions (such as the Carriage of Goods by Sea Act or Warsaw/Montreal Convention, as applicable). We are not liable for indirect, consequential, or special damages, including lost profits or business interruption, except where prohibited by law.
4. Payment Terms
Invoices are due according to the payment terms confirmed at booking, typically prior to release of cargo at destination unless credit terms have been separately established. Late payments may incur interest charges and may result in cargo holds until payment is received in full.
5. Customer Responsibilities
You are responsible for providing accurate and complete information about your shipment, including commodity descriptions, values, weights, and dimensions, and for ensuring your goods comply with applicable import and export regulations. You are liable for any fines, penalties, or delays resulting from inaccurate or incomplete declarations.
6. Cargo Insurance
Carrier and forwarder liability may be limited by the applicable transport document, tariff, convention, or service terms and may be substantially less than the commercial value of the goods. Customers should request cargo insurance for high-value, fragile, or otherwise sensitive shipments. Insurance applies only when confirmed in writing and is subject to the applicable policy terms and exclusions.
7. Dispute Resolution
Any disputes arising from these Terms or our services will first be addressed through good-faith negotiation between the parties. If unresolved, disputes will be settled through binding arbitration in Los Angeles, California, in accordance with the rules of the American Arbitration Association, except where applicable law requires otherwise.
8. Modifications to Terms
We may update these Terms from time to time. Changes will be posted on this page with a revised effective date. Continued use of our services after changes take effect constitutes your acceptance of the updated Terms.
